私は、民法、とりわけ不法行為法を中心に研究しております。不法行為法とは、被害者に発生した損害を加害者に転嫁するための法的な仕組みと捉えることができます。これまでの不法行為法は交通事故や公害などの人身被害を念頭に構築されてきました。しかしながら、現代では、金融商品の販売によって損害が発生した場合の救済や、知的財産権侵害による損害賠償など、人身被害に伴わない経済的な損害の賠償が問題となっています。また人身被害の局面においても、死亡との因果関係を認定することができない場合であっても、生存していた相当程度の可能性が証明されることで被害者に一定の救済を認めるなど、新たな不法行為法の動きに注目して研究しています。
